States with Magazine Capacity Restrictions — Updated April 2026

This article reflects the law as of the date above and is provided for informational purposes only — it is not legal advice. Which States Restrict Magazine Capacity?

As of April 2026, the following states have enacted magazine capacity restrictions. Several of these laws are currently being challenged in court — see the notes for each state.

State-by-State Magazine Capacity Laws

California

Bans the possession, manufacture, importation, sale, and transfer of magazines that hold more than 10 rounds. The Ninth Circuit Court of Appeals upheld the ban 7-4 in Duncan v. Bonta (March 2025). The U.S. Supreme Court declined to hear a related challenge in June 2025. The law is fully in effect.

Colorado

Bans the sale, transfer, and possession of magazines that hold more than 15 rounds. The 15-round limit has not changed. Note: SB25-003 (signed 2025) adds new dealer transfer restrictions effective August 1, 2026, but does not change the round limit.

Connecticut

Bans the sale, transfer, or possession of magazines that hold more than 10 rounds. Magazines lawfully possessed before the ban may be retained by the original owner. No changes since 2024.

Delaware

Bans magazines that hold more than 17 rounds. Delaware's threshold is higher than most other states — magazines holding 17 rounds or fewer are legal. No changes since 2024.

District of Columbia

Status changed — ban currently not enforced. The D.C. Court of Appeals ruled 2-1 in Benson v. United States (March 2026) that the District's 10-round magazine ban violates the Second Amendment. The conviction was vacated. D.C. is seeking to preserve the law, but no stay has been issued. The ban is not currently being enforced. This ruling may be subject to further appeal.

Hawaii

Bans magazines that hold more than 10 rounds for handguns. Long gun magazines are not restricted under state law. No changes since 2024.

Illinois

Law in effect but under active legal challenge. The statewide ban limits magazines to 10 rounds for long guns and 15 rounds for handguns. A federal district court issued a permanent injunction in November 2024 ruling the ban unconstitutional, but the Seventh Circuit Court of Appeals stayed that injunction pending appeal. The law remains enforceable while the appeal is pending. A final ruling is expected to be appealed to the U.S. Supreme Court regardless of outcome.

Maryland

Bans the manufacture, sale, transfer, purchase, and receipt of magazines that hold more than 10 rounds. Possession of previously-owned magazines is not prohibited. No changes since 2024.

Massachusetts

Bans the sale, transfer, or possession of magazines that hold more than 10 rounds, unless they were lawfully possessed before September 13, 1994. No changes since 2024.

New Jersey

Bans magazines that hold more than 10 rounds. Unlike some other states, New Jersey does not grandfather previously-owned magazines — possession of any magazine over 10 rounds is prohibited. No changes since 2024.

New York

Bans the possession of magazines that hold more than 10 rounds. The limit was established under the 2013 SAFE Act. No changes since 2024.

Oregon

Status pending — ban not yet in effect. Ballot Measure 114 (2022) includes a 10-round magazine limit, but the provision has not been enforced while constitutional challenges work through the courts. The Oregon Court of Appeals upheld the law in March 2025, and the case is now before the Oregon Supreme Court, which heard oral arguments in November 2025. As of April 2026, the Oregon Supreme Court has not issued a ruling and the magazine limit is not being enforced. Check back for updates.

Rhode Island

Bans magazines that hold more than 10 rounds. No changes since 2024.

Vermont

Limits magazines to 10 rounds for long guns and 15 rounds for handguns. No changes since 2024.

Washington

Limits magazines to 10 rounds. The Washington State Supreme Court upheld the ban 7-2 on May 8, 2025, ruling high-capacity magazines are not "arms" protected by the Second Amendment. The law is fully in effect.

This Is a Rapidly Changing Area of Law

The legal landscape for magazine restrictions is shifting quickly. Court decisions in D.C. (Benson v. United States, 2026) and ongoing federal circuit court splits mean some of these laws may be struck down, modified, or newly enforced with little notice. Minnesota is currently considering magazine restriction legislation that, if passed, could take effect as early as July 2026.
